The lawyers must be thrilled.
This whole thing is stupid. Our listing agreement clearly discusses co-op commissions and the negotiability of commissions. If the listing was signed, it is assumed in contract law that it was read.
I don’t understand why everyone just backed down and settled.
I also don't understand why we aren't all quitting NAR at this point. This whole suit should have been thrown out immediately because it’s based on false narratives and BS in the first place.
NAR should have filed for bankruptcy before agreeing to this ludicrous settlement.
Every broker in the country could compile a list of commissions charged for each of the past few years, and I GUARANTEE that in itself would prove there’s no “collusion” or set rates across the country.
We could have a list and data within a day if NAR would have said, 'This is total BS and WE can PROVE IT WITH FACTS AND DATA!'
30% goes to the attorneys and we are the ones who are "price fixing."
I don't even understand how Redfin even has to pay. I don't love their business model, but the very fact that their business model exists is full proof that this lawsuit and the verdict should be invalidated.
What a ridiculous joke the legal system has allowed itself to become! Facts and truth mean nothing anymore, it seems.
If you bankrupt the industry association (one of the largest ones in the country) that lobbies hard for personal property rights — then you create disruption.
Disruption of the status quo allows the foxes into the henhouse. Make no mistake, this isn't about commissions — this is about fundamentally changing our industry and an all-out assault on property ownership by big Corp / Wall Street.
There is a reason land is being snatched up. There is a reason big Corp money is buying oodles of homes and turning them into rentals. Dig deep — anyone can follow the breadcrumbs.
I think we as Realtors should all join together and counter-sue. Think about it, over 1 million of us suing the system that is trying to sue us.
